This ban follows the publication, in May 2025, of Regulation (EU) No 2025/877, known as "Omnibus VII", amending Regulation (EC) No 1223/2009 on cosmetic products, with regard to the use of certain substances classified as carcinogenic, mutagenic or toxic to reproduction (CMR). Within this framework, several substances are regularly subject to bans or restrictions in order to take into account new scientific data.

Cosmetic products are defined as "Any substance or mixture intended to be placed in contact with the external parts of the human body (epidermis, hair and scalp, nails, lips and external genital organs) or with the teeth and the mucous membranes of the mouth with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance, protecting them, keeping them in good condition or correcting body odours" (Article 2 of Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009, hereinafter referred to as the "cosmetics" Regulation).

Article 10 of the regulation specifies that "the safety assessment of the cosmetic product, as set out in Annex I, Part B, shall be carried out by a person holding a diploma or other qualification certifying completion of university-level theoretical and practical training in pharmacy, toxicology, medicine, or any other similar discipline, or equivalent training recognized by a Member State," i.e., by a safety assessor.

Climate & Resilience Law, Article 23 - Development of Bulk Sales

This measure aims to reduce packaging, particularly primary packaging, and to develop the sale of unpackaged products, especially in bulk, in the retail sector.

The current restriction in Article L.120-1 of the Consumer Code concerning "mobile sales outlets" is removed, in order to broaden the possibilities for selling without packaging.
